Representative Cases
Obtained a dismissal in a products liability case in the United States District Court for the Middle District of Georgia. The plaintiffs suffered catastrophic burn injuries as a result of a portable gasoline container explosion with total medical bills exceeding $11,000,000. Jason filed a Motion for Summary Judgment, arguing that the plaintiffs could not prove that his client/defendant manufactured, sold or distributed the subject product. The plaintiffs ultimately dismissed the case against Jason’s client/defendant with prejudice rather than respond to the Motion for Summary Judgment.
Obtained summary judgment in a premises liability case in the United States District Court for the Northern District of Georgia. The plaintiff suffered a serious injury requiring surgery and claimed more than $250,000 in special damages as a result of a slip and fall that occurred on defendant’s premises. Jason filed a Motion for Summary Judgment, arguing that the defendant was an out-of-possession landlord and did not owe the plaintiff a duty of care, and also that the plaintiff failed to prove knowledge of the claimed hazard superior to that of the defendant. The Judge agreed and granted the Motion for Summary Judgment.
Obtained summary judgment for an insurance company in a first party water damage case in the State Court of Gwinnett County. The plaintiff alleged that the insurance company was liable for breach of the insurance contract, and vicariously liable for the torts of its water mitigation services vendor, and claimed more than $300,000 in property damage. Jason filed a Motion for Summary Judgment, arguing that the insurance company was not liable for the torts of its vendor, an independent contractor, and also that the insurance company had met its obligations under the insurance contract. The Judge agreed and granted the Motion for Summary Judgment.
Obtained defense verdict in a premises liability case in the State Court of Cherokee County. The plaintiff alleged that she suffered a serious injury as a result of a fall through a stairwell on the defendant’s premises. The plaintiff asked the jury to award more than $120,000 in damages. Instead, finding that the plaintiff failed to prove liability, the jury entered a verdict for the defendant.
