Craig Terrett and J. Robb Cruser won summary judgment on behalf of GEICO based upon the insured’s late notice of a personal injury claim. The claimant, who was severely injured on the property of the insured, sought coverage under the insured’s $1,000,000 umbrella policy. The insured failed to timely notify GEICO of the incident or of the suit that was filed against the insured stemming from the injury. The Court found that the insured’s late notice failed to satisfy the necessary condition precedent to invoke coverage under the umbrella policy as a matter of law.
