Craig Terrett and Robb Cruser’s win on summary judgment in a late notice case was affirmed by the Georgia Court of Appeals. The claimant, who was severely injured on the property of the insured, sought coverage under the insured’s $1,000,000 umbrella policy with GEICO. The insured failed to timely notify GEICO of the incident or of the suit that was filed against the insured stemming from the injury. The Court of Appeals agreed with the trial court that the insured’s late notice failed to satisfy the necessary condition precedent to invoke coverage under the umbrella policy as a matter of law.
