Cruser Mitchell obtained a defense verdict for its client, an international hospitality company, after a three-day jury trial in Beaufort County, South Carolina. The plaintiff fell in one of the resort’s hot tubs and suffered broken bones. The plaintiff claimed that the hot tub was defectively designed and maintained, but our attorney successfully argued that the plaintiff’s hot tub safety and design expert should be excluded from testifying because he was not qualified to offer an opinion on the safety of the hot tub. After deliberating for 24 minutes, the jury returned a defense verdict.
