J. Robb Cruser and Katy Hurley secured a venue change for an alleged bad faith negligent failure to settle action that arose out of a Florida motor vehicle accident. Although the Plaintiff was a resident of Glynn County, Georgia, she filed this action in the Superior Court of Dekalb County. Defendant, a Maryland Corporation, resisted this forum-shopping effort and removed the matter to the United States District Court for the Northern District of Georgia and moved to transfer this matter to the United States District Court for the Middle District of Florida since all pertinent events including the accident and the claims handling occurred in Florida. Plaintiffs opposed this Motion. Judge Thomas Thrash granted the Motion to transfer finding that the case had no connection whatsoever with Dekalb County or the Northern District of Georgia and sent the case back to Florida.
