J. Robb Cruser and Rusty Grant obtained summary judgment in the Superior Court of Henry County. In the underlying case, plaintiff was a passenger in her own vehicle, which was uninsured, and was injured in an automobile accident. Plaintiff sought damages under the uninsured coverage of a GEICO insurance policy held by her mother, arguing that she qualified as an insured under her mother’s policy. The Court concluded that while the plaintiff did meet the definition of an insured, the policy’s “uninsured auto” coverage did not include an auto owned by the policyholder or a relative of the policyholder.
