Robb Cruser won summary judgment in a premises liability case where the plaintiff claimed he suffered debilitating back pain and incurred approximately $40,000 in medical expenses. Plaintiff fell when he stepped on an oil spill in a parking lot of a QuikTrip (QT) store. Through the course of discovery, Robb and Mark were able to develop evidence that the plaintiff had knowledge of the oil spill. A DeKalb County Superior Court judge granted QT’s motion for summary judgment finding that the evidence showed as a matter of law that the plaintiff had superior knowledge of the oil spill.
