Robb Cruser secured a summary judgment in the State Court of Cobb County, Georgia for an insurer based on a late notice policy defense. The terms of plaintiff’s uninsured motorist’s coverage required that plaintiff give notice to insurer or its agent “as soon as possible after an accident.” In this case, however, plaintiff did not notify insurer until 11 months after the accident, claiming that she was unaware of the need to notify defendant until she spoke with an attorney. Robb Cruser argued, and the Court agreed, that plaintiff’s eleven month delay was unreasonable.
