Rondiene E. Novitz and Magda DeMoya Coyle obtained Summary Judgment for a slip and fall case at a roller skating rink. The case was pending in the Suffolk County Supreme Court. The plaintiff alleged his rented roller skates were defective in that the wheel locked up, causing him to lose his balance and fall. The plaintiff underwent two surgeries involving hardware for a fractured ankle; however, the hardware remained as they were unable to remove it. The Court held the plaintiff assumed the risk of falling, which is inherent in the activity of roller skating, and that the plaintiff failed to establish the roller skates were defective.
