Rondiene E. Novitz and Magda DeMoya Coyle Obtained Summary Judgment for Upscale National Restaurant Chain

Rondiene E. Novitz and Magda DeMoya Coyle obtained Summary Judgment for an upscale national restaurant chain in a slip and fall case. The case was pending in the Bronx County Supreme Court. The plaintiff alleged she slipped and fell on a wet floor in the defendant’s restroom, and claimed the floor looked and smelled as if it had been recently mopped. The Court found even if the defendant created the wet floor by mopping it, the wet floor was readily observable by the reasonable use of plaintiff’s senses, and the condition of the wet floor being mopped is not inherently dangerous.
