Rondiene Novitz and Scott Gurtman obtained a defense verdict in a Federal Age Discrimination case. After five days of testimony, the jury returned a unanimous verdict in favor of the defendants in less than two hours. Plaintiff was 59 years old when she was denied tenure and terminated from her position as a music teacher. She claimed she did not get the appropriate amount of observations and evaluations during her probationary period and was treated differently than the younger employees at the school. Our team argued while she may have been treated differently, it was not because of her age. Plaintiff’s last demand was $1.5 million. No offer was made.
