Rusty Grant obtained a defense verdict in connection with a highway accident on Interstate 20 that led to multiple fractures in the plaintiff’s hip and leg. Defendant claimed that a third vehicle cut her off, forcing her into plaintiff’s travel lane. Plaintiff claimed that she never saw a third vehicle. Defendant’s insurance carrier tendered its limits to plaintiff, as did plaintiff’s underinsured motorist carrier, State Farm. State Farm then filed suit against defendant, alleging it was entitled to reimbursement of $25,000. The State Court of Cobb County allowed the case to proceed to trial in plaintiff’s name only, prohibiting any reference to State Farm or the payments plaintiff had previously received. The jury, however, found that defendant was not at fault for the accident and declined to award any damages.
