The U.S. Supreme Court denied a petition for writ of certiorari filed by former inmates of the Fulton County Jail, who were represented in the U.S. Supreme Court by former Solicitor General Paul Clement. This ends a decade-old would-be class action and is a hard-fought win for the former sheriff and her defense team, including Cruser & Mitchell. The Eleventh Circuit granted the sheriff’s motion for summary judgment, dismissing Plaintiffs’ challenge to the Jail’s general policy of visually strip-searching, for security reasons, all inmates booked into the general population of the jail, even if such entry occurs after returning from the courthouse or after posting bond or being ordered released. This decision remains the law in this Circuit.
